I have been out of the country and just now in receipt of your letter dated November 25, 2014 adjourning the Subject hearing.

This is the third adjournment at no fault of my own.

You are aware that I am a resident of the State of Maine. Rescheduling my appearance in New Jersey has already caused me to incurred expensive trip cancellation fees/assessments and personal/professional inconveniences.

I would like to discuss with you my previous request that I might now utilize the telephonic and/or video conferencing procedures which I understand are available.

I have never met Mr. Rosen and all my dealings have been via telephone or e-mail. Therefore, Mr. Rosen should have no legitimate reason to expect me to appear personally. Moreover, I have prepared a detailed opening statement with accompanying attachments and exhibits. I have taken sedulous care to document my case with meticulous detail that effectively and conclusively produces a preponderance of evidence that supports the reasonableness of my position.

I am prepared to offer such statement in advance of the reschedule hearing. It should provide a road map to effectively follow my appearance by conferencing procedures. This procedure should not place Mr. Rosen at any disadvantage should he wish to cross-examine me.

I await your notice of a convenient time for me to call.
