My name is Debra Woodall, I am writing in hope you can help me with my legal problem.
We have common friends, in Jamie Morris and Deborah Healy Morehead. I was talking with Deborah and, she highly recommend your name and urged me to contact you about my legal problem.
This problem deals with Real Estate and a sale of a home that I bought from my 20 year "best friend and her husband", (Reba and Andy Arvin)
and there non disclosure of structural issues on the home they sold me in 2016.
I bought my "retirement" home (November 2016) from my best friend, Reba, and her husband. I'm originally born and raised in Washington, but, I am still living in California, until I retire in January 2018. It has always been my desire to retire close to my mother and best friends.
Reba and Andy Arvin sold me their first home. It was my intention to retire in 3 years, but because of chronic health issues and my mother's illness I have intentions of retiring this next year.
In August, I had spent time at the home and noticed that something isn't right, I asked a company about putting down a vapor barrier, and possible 1/2 basement and to check the foundation of the home. We checked the access to the home, and discovered many things, the bathroom side we checked, it was damp and moldy smelling. Andy had jacked up the bathroom and the jack wasn't sitting on anything solid, it was just dug
into the side of the dirt. The other access under the kitchen you could not access because there was about a foot space. I was told by Reba Arvin, that Andy jacked up the kitchen floor and, that he had to cut a hole in the kitchen floor to "fix" the floor before they put the new linoleum tiles. So I couldn't see by looking under the kitchen access where the jack was put, Reba said he left the jack under the kitchen floor, I'm nervous to think of how that jack is sitting, since I saw the one under the bathroom.
The air conditioner/heating duct was not attached, the main beam was gone, probably water rot. The structure of the home is in very poor condition. None of this was disclosed by Reba, and Andy and not even the closing attorneys (Lett and Jones, Loogootee)
Before we entered into contract Reba had told me they were going to do some repairs that should be complete before I move back. I can provide the list of repairs that were to be completed and all information to you later at your request.
My point is that my best friend, and her husband did not disclose any of this information to me when they sold the home to me. At this point I'm not sure if the damages were done when Andy jacked up the bathroom, and the kitchen. When I saw this, I called the closing attorney, and they could not help me because they work with the Arvin's on other things, there was nothing in the closing papers disclosing the structure issues. I didn't get a property inspection as I trusted them and, our 20 friendship history.
I never thought the structure would be an issue.
Since discovering all of this, I feel they took advantage of our twenty year friendship and ripped me off for 35,000 plus 1,000. earnest money. I want to sue them for not disclosing the condition of the structure of the home. There are many other things wrong but, for the sake of being brief, and to get to the point of why I am contacting you, for your help with this matter.
