I was struck by a moving vehicle while I was on my bicycle on 3.6.17. Basically, I was merging right to re-enter the bike lane when a tour bus merged left, crossing the bike lane into the right lane a split second after I merged, leaving me no choice but to evade back into the middle lane. That is when I was struck by a vehicle that was accelerating from behind me in the middle lane. When I was struck, I had barely crossed the lane when I was swiped on my left side. The car spun me like a top and slammed to the ground between the car and the tour bus. I don't know how it is that I am even breathing still or not severely crippled right now. My shaking as I write this. I am certain that the car that struck me was speeding. The posted speed on Kalakaua in Waikiki is 25mph; a speed I regularly reach and maintain in regular traffic when the bike lane is not safe for travel. I am a competent driver and bicyclist, and I am aware of/ follow the traffic laws. Currently, there is a cauldron of hardship (mental, physical, professional, etc.) that I am experiencing that is directly related to this accident. I don't have any info from the tour bus co. or the driver that struck me. That information was taken by officers at the scene. The police report hasn't been released yet though I am still attempting to receive a copy. That being said; I am certain I was operating with in the law and used prudent judgment while merging in traffic on my bicycle, which is a maneuver that I have performed 100,000 times in complete safety and without incident. Do I have a claim? If so, what are my options?
